Le prossime settimane porteranno per la nostra associazione un importante e radicale cambiamento, un cambiamento che in parte è conseguenza dell’ingresso in campo della Riforma del Terzo Settore, un Decreto Legislativo pubblicato in Gazzetta Ufficiale il 3 luglio 2017, n° 117 col titolo di “Codice di Riforma del Terzo Settore”.
Si tratta di una nuova normativa che crea un nuovo ordinamento nel settore degli enti associativi, mettendo insieme, in un unico testo legislativo, tutte le norme che regoleranno ogni aspetto della vita delle associazioni che diventeranno degli Enti del Terzo Settore (ETS).
Da parecchi mesi l’Associazione Mirò ha iniziato a valutare tale normativa e la probabile struttura definitiva di questa Riforma, e a seguirne l’iter attuativo. Argomenti molto complessi, così come sarebbe anche spiegare i dettagli, peraltro non ancora del tutto definiti, di questa Riforma. Sfortunatamente, il già non semplice iter attuativo di questa Riforma, dal 2017 a oggi, è stato più volte rallentato dai diversi cambi di Governo e recentemente dall’emergenza Covid-19.
Per questo al momento la Riforma non è ancora del tutto operativa, mancano ancora parecchi decreti attuativi per giungere alla sua forma definitiva e piena operatività, ma la recente approvazione del decreto che istituisce il Registro Unico del Terzo Settore (RUNTS), segna un passo in avanti importante.
Il RUNTS, che dovrebbe entrare in funzione indicativamente ad aprile, infatti è un elemento cardine e imprescindibile per l’operatività della Riforma, senza il quale non possono esistere Enti del Terzo Settore. Possiamo definire questo Registro una sorta di “database pubblico” degli Enti del Terzo Settore, dove saranno inserite tutte le informazioni identitarie delle associazioni e in cui le stesse saranno tenute a pubblicare ogni anno i bilanci o i rendiconti finanziari.
La Riforma, al di là di alcuni aspetti come il RUNTS, non apporta in realtà grandi novità alle normative già in vigore, il suo scopo non dichiarato è quello di far “fallire” una grossa fetta delle centinaia di migliaia di associazioni presenti in Italia, e per questo è stata redatta semplicemente in modo da rendere più complicata la gestione delle associazioni, soprattutto dal punto di vista fiscale, e in modo da rendere ancora più difficile la sopravvivenza per quegli enti che decideranno di non aderire alla Riforma e continuare a seguire le normative già esistenti non cancellate dalla Riforma.
Per questo l’impatto della Riforma non sarà affatto semplice, e metterà tutti gli Enti associativi no profit di fronte a delle scelte, ma soprattutto di fronte alla necessità di dover adottare una nuova mentalità gestionale imprenditoriale, e una struttura solida e credibile.
L’esperienza della pandemia Covid-19 ci ha inoltre fatto capire che gli Enti no profit devono anche saper pensare a nuove strategie e nuove forme di socialità, per continuare a dare il proprio contribuito alla società anche nei periodi più difficili. Siamo quindi messi di fronte alla necessità di cambiare, di fare un passo avanti, di guardare al futuro con una nuova visione di impegno sociale e culturale.
C’è un nuovo futuro che sta prendendo forma in queste settimane, che sarà diverso da quanto è stato finora, ma crediamo che sarà migliore! Seguiteci, perché avremo importanti notizie nelle prossime settimane.

The next weeks will bring an important and radical change for our association, a change that is partly a consequence of the entry into the field of the Third Sector Reform, a Legislative Decree, published in the Official Gazette on 3 July 2017, n ° 117, with the title of “Code of Reform of the Third Sector”.
In practice, this is a new legislation that creates a new order in the sector of associations, putting together, in a single legislative text, all the rules that will regulate every aspect of the life of the associations that will become Third Sector Entities (ETS).
For several months the Associazione Mirò has begun to evaluate this legislation and the probable definitive structure of this Reform, and to follow its implementation process. Very complex topics, as it would also be to explain the details, however not yet fully defined, of this Reform. Unfortunately, the already difficult implementation process of this Reform, from 2017 to today, has been slowed down several times by the various government changes and recently by the Covid-19 emergency.
For this reason, at the moment the Reform is not yet fully operational, several implementing decrees to reach its definitive and fully operational form are still missing, but the recent approval of the decree establishing the Unique Register of the Third Sector (RUNTS), marks a step in forward important.
The RUNTS, which should come into operation approximately in March, is in fact a key and essential element for the operation of the Reform, without which there can be no Third Sector Entities. We can define this Register as a sort of “public database” of Third Sector Entities, where all the identity information of the associations will be entered and in which they will be required to publish annual financial statements or reports.
The Reform, beyond some aspects such as the RUNTS, does not actually bring great news to the regulations already in force, its undeclared purpose is to make a large portion of the hundreds of thousands of associations present in Italy “fail”, and for this reason it was drawn up simply in order to make the management of associations more complicated, especially from a fiscal point of view, and in order to make survival even more difficult for those entities that decide not to adhere to the Reform and continue to follow the existing regulations not canceled by the Reform.
For this reason, the impact of the Reform will not be simple at all, and will put all non-profit associations in the face of the need to adopt a new entrepreneurial managerial mentality, and a solid and credible structure.
The experience of the Covid-19 pandemic has also made us understand that non-profit organizations must also be able to think about new strategies and new forms of social relations, in order to continue to contribute to society even in the most difficult periods. We are therefore faced with the need to change, to take a step forward, to look to the future with a new vision of social and cultural commitment.
